Do I Need a Seller’s Permit in San Jose?

Yes. Anyone selling taxable tangible personal property in California needs a CDTFA seller’s permit. What Triggers Sales Tax Nexus in California?

Two things trigger California sales tax nexus: physical presence, or $500,000 in sales delivered into California. Either one obligates you to register with the CDTFA and collect tax. Nexus is the connection between your business and the state that creates a collection duty.

What counts as physical nexus?

Physical nexus comes from a real in-state footprint. That includes an office, store, or warehouse, inventory stored in the state, employees or agents operating in California, and owned or leased property. Inventory held in third-party fulfillment centers counts, so Fulfillment by Amazon (FBA) stock in a California warehouse creates nexus even for a remote seller.

How does California’s $500,000 economic nexus threshold work?

You have economic nexus once your combined sales of tangible personal property delivered into California exceed $500,000 in the current or preceding calendar year, per Assembly Bill 147 (AB 147), effective April 1, 2019, per the CDTFA. California uses no separate transaction-count test, unlike states with a “$100,000 or 200 transactions” rule.

What Is the Difference Between Sales Tax and Sellers Use Tax in California?

Sales tax is imposed on the retailer for in-state sales of tangible personal property. Use tax applies to the use, storage, or consumption of that property when sales tax was not collected, at the same combined rate. The buyer or an out-of-state seller owes it.

Out-of-state retailers with California nexus but no in-state physical presence collect seller’s use tax and report it under a different CDTFA category. The rate matches the sales tax rate, but the reporting line differs, and district collection obligations can vary depending on where the goods are delivered.

Is software taxable in San Jose, California?

Prewritten software sold on tangible media, such as a disk or USB drive, is taxable in California. Software delivered electronically, custom software written for one client, and cloud-hosted Software-as-a-Service (SaaS) are generally not taxable, per CDTFA guidance. California is more software-friendly than many states, so most downloaded and hosted products fall outside the tax.

How Do Online Sellers Handle San Jose Sales Tax?

Remote sellers over the $500,000 threshold must collect the full 10.000% combined San Jose rate on taxable orders delivered into the city. Marketplaces collect for their third-party sellers under California’s Marketplace Facilitator Act, effective October 1, 2019, which makes platforms like Amazon, Etsy, and eBay responsible for collecting and remitting tax on facilitated sales.

What Is the San Jose Business Tax?

San Jose levies a separate city business tax on companies with an office or employees in the city. The City of San José administers it, not the CDTFA, so it is distinct from your state sales tax obligation.
